TERMS AND CONDITIONS:
A copy of these terms and conditions will be supplied in writing before any work is undertaken on any computer system or equipment.
Please read the following carefully, these are the terms and conditions under which we conduct our business and form the basis of the partnership between you, the customer and ourselves. By accessing and using this site you agree to be legally bound by it`s terms and conditions. Please review these terms and conditions regularly, as changes will be applied immediately and replace those already in existence. We reserve our rights to change prices and details of our services at any time and without prior notice.
1. All site software,design, images, written text, artwork etc still remains the property of the copyright owners and Simply Computers. You must not reproduce, modify, create derivative works from display, perform, publish, distribute, disseminate, broadcast or circulate any material to any third party the display and distribution of the material via a third party website without express written consent of Simply Computers.
2. This site and all material contained thereon are distributed and transmitted on a “as is” and “as available” basis without warranties of any kind, either express or implied. Simply Computers are not responsible or liable for any infection of your computer systems, neither delay, inaccuracies, error, omission arising from your use of this site or with respect to any information and material contained on it. Simply Computers and third party providers to the site will not be liable for damages of any kind from the use of, or the inability to use the materials contained on this site.
3. We take protection of your personal details and information seriously and will not divulge any information used or retained by ourselves in respect of yourselves to any third party individual or company, either voluntarily or by request.
4. We reserve the right to refuse to undertake any work at any time, from customers who are abusive or threatening, either by word or behaviour.
5. Currently, payment is required on completion of any work undertaken. We reserve our statutory rights to pursue any outstanding debts. Interest will be added to outstanding debts, not paid within one month from the date payment was due.
6. We will not be held responsible where the client supplies us with his own chosen components purchased elsewhere and then, if fitted by ourselves, is found to be incompatible or causes damage to either that component or other equipment belonging to the client.
7. We shall not be responsible in cases when following a computer repair, a client then fails to install or maintain a suitable firewall and anti-virus software and neglects to take reasonable steps to ensure his equipment is suitably protected whilst connected to the internet, or other communication source. This will invalidate our warranty provided, following the repair.
8. We shall provide a warranty on all repair work carried out by ourselves, for a period not exceeding one month on labour and our listed services. We provide a warranty, not exceeding twelve months, on all new components, unless otherwise stated. All of our new computer systems carry a warranty ranging from twelve months to three years or more, depending on the offer at the time and include, both parts and labour. 9. We do not deal in copied or pirated software. If your operating system or other software is not legal, we cannot use it. Similarly, we do not make back-ups of illegal downloaded music, pictures, software etc.
10. We shall not be held responsible where a client fails to take responsibility with his computer equipment by failing to ensure it is suitably plugged into a protective mains socket which guards against sudden power surge or power loss or failure. We cannot guarantee computers and associated equipment against lightning strike, fire, or other damage such as flood, high wind, earthquake or tremor, acts of war or terrorism, any other series of unexpected or natural event, or malicious damage, or cases where the owner or his agent does not take normal, acceptable, preventative care.
11. We charge a fixed fee of £10.00 to come to your home or office and perform a "Quick Fix" on your computer within 30 minutes. Should it look likely more than 30 minutes are required, we will bring the computer back to our workshops for the "Standard Fix" service which is priced at £25.00. On completion, the machine will be delivered to the address from which it was collected and the total sum, not including any new parts will be £35.00. Similarly, you may bring your computer to us for a "Quick Fix" service, which will be charged at just £10.00, excluding any new parts. If the repair seems likely to take longer than 30 minutes, we will implement the "Standard Fix" service charged at £25.00, new parts charged extra. However, should the computer be removed from your premises and then you decide not to proceed with any further repairs, for whatever reason, we will charge a total of £20.00 to return the computer to you, unless you wish to arrange it`s collection yourself, either personally or by an agent of your choice. In any case, you will be required to contact us first to book an appointment prior to collection.
12. Whilst every care is taken to preserve and safeguard a client`s personal documents, we cannot be held responsible for any data loss however caused during the processes used by ourselves. If you accept our services you agree to these terms and conditions. We accept no liability or responsibility for the loss of any personal documents stored on any computer or other electronic storage device including but not exclusively:
• Hard drives (internal and external).
• USB powered storage media, pen drives, memory sticks etc.
• Smart media storage cards, as fitted in mobile phones, ipods, camera`s etc.
• Floppy disk drives.
by the use of Malicious software scanning, Data copying, Data recovery techniques, Data transfer from device to device and Hardware diagnostic scans or any other device or service used by ourselves in the pursuance of personal document and data preservation and safekeeping.
Personal documents or data shall relate to those created through Microsoft Office or a programme of a similar nature, such as Open Office etc, Music files either downloaded or copied or ripped onto the storage media. Photographs and video footage, again either through download, copying or ripping. Emails and address books stored in either Microsoft Outlook, Outlook Express, Windows Mail or any other mail storage media.
It shall be the responsibility of the client in all cases to inform us of any other software installed and used for the storage of such media as listed above and known places where the data is stored.
It shall also remain the responsibility of the computer user or his agent to inform us, in the case of all instances of data backup, data copying and data recovery of all passwords used for all user accounts on the computer and all instances where personal documents and data have been encrypted for protection and privacy. We will not be held responsible, where this information is not provided, for the safekeeping of any personal documents and data of any kind.
13. We accept no liability for the failure to save or recover any personal documents from any computer where malicious software is present and effectively running or where the operating system itself is in such an unstable condition as to render the copy or recovery process impossible or difficult.
14. We accept no liability for the failure to save or recover any personal documents from any computer where the hard drive(s) is in the process of failure, or has already failed.
